How to find your HS code and avoid a reassessment

The same goods under neighbouring codes can mean 0% or 30%. Errors surface late — reassessment is possible for three years.

Why this is not a formality

The HS code determines three things: the duty rate, the set of permits required, and whether the goods fall under a ban or quota. Get the code wrong and the whole calculation is wrong.

The spread is real. Children's clothing (6111) is 10%. Adult t-shirts (6109) are 20%, but not less than 0.5 dollars per piece. Beef (0201) is 0%. Furniture (9403) is 15%, but not less than 0.4 dollars per kilogram. Neighbouring headings can differ threefold.

How the code is built

In Uzbekistan the code has ten digits, read left to right from general to specific:

The first six digits are the same worldwide — the Harmonized System. The last four are national.

The core classification rule

Goods are classified by material and function, not by the wording on the invoice or what the seller calls them. A supplier may write "textile article" — what matters to customs is whether it is knitted or woven, cotton or synthetic, adult or children's.

Where goods could fall under several headings, the more specific description prevails over the general one. Sets are classified by the item that gives the set its essential character.

Four expensive mistakes

Taking the code from the supplier. A Chinese export code belongs to Chinese nomenclature. The first six digits will match, the last four will not — and the rate follows the full code.

Picking the "cheaper" code. That is inaccurate declaration. Article 227-22 of the Administrative Code: 7 to 15 base units for an official, with confiscation, plus reassessment.

Confusing children's and adult items. The rate differs twofold and is decided by the size range, not by who will actually wear it.

Ignoring composition. Blended fabrics are classified by the predominant fibre. 60% cotton with 40% polyester is one heading; the reverse ratio is another.

How to protect yourself in advance

If the code is arguable, an advance classification decision is available — chapter 52 of the Customs Code. You submit a description before shipping and receive an official ruling on the code. It is a paid service, but with the ruling in hand an inspector cannot reclassify the goods at the border, and therefore cannot reassess.

It pays off particularly for large, repeating consignments: the ruling is not limited to one shipment.
